Silvia Baraldini, nasce a Roma nel 1947, si forma negli USA, dove il padre lavora come diplomatico presso l’ambasciata italiana.
Qui si avvicina ben presto al grande moto giovanile di protesta sorto per manifestare il proprio dissenso alla guerra in Vietnam.
E' così che a cavallo tra gli anni '60 e '70 del Novecento, Silvia Baraldini diviene una strenua sostenitrice del movimento afro-americano, in tutte le sue manifestazioni più radicali ed armate, convinta non solo del fatto che le condizioni in cui versa la comunità nera statunitense rappresentino l'espressione più violenta e brutale del dominio politico e sociale capitalistico ma, soprattutto, consapevole del fatto che solo l'unione tra i movimenti privilegiati dei bianchi con quelli più emarginati e abusati dei neri avrebbe potuto sfociare in una palingenesi rivoluzionaria. Di qui il suo supporto militante ai gruppi più radicali del momento, dal Black Panthers Party for Self-Defens al Black Liberation Army, passando dalla May 19 Coalition, organizzazione di ideologia comunista in cui militarono alcuni membri dei Weather Underground.
Poi, nel 1983, l'arresto e la condanna: 44 anni di carcere, viene accusata di aver organizzato e partecipato all'evasione e alla fuga di Assata Shakur, militante nera detenuta nel carcere di Clinton nel New Jersey, oggi esiliata a Cuba e ancora nella lista dei più pericolosi terroristi degli USA. L'operazione avviene senza spargimento di sangue, ma Baraldini subisce l'applicazione nei suoi confronti della legge RICO, ideata per combattere la criminalità organizzata e il terrorismo interno, dunque su di lei ricadono indiscriminatamente tutti i capi d’accusa che riguardano il movimento di cui è parte, compresa una rapina mai avvenuta.

Alla proposta da parte del FBI di scambiare la sua libertà con i nomi dei 'complici', Silvia Baraldini rifiuta e viene dunque trasferita a Lexington, nel carcere sotterraneo di massima sicurezza, dove trascorre quasi due anni in condizioni di totale isolamento sensoriale ammalandosi gravemente.
I capi d'accusa:
Il 2 novembre 1979 aveva concorso con altri all'evasione di Assata Shakur, alias Joanne Chesimard, "l'anima" del Black Liberation Army (BLA), che stava scontando una condanna all'ergastolo per omicidio di un agente di polizia stradale;
Fu accusata di essere un'ideologa sia del movimento "19 maggio" sia di altri movimenti afro-americani di liberazione, tra cui "La famiglia" che forniva appoggio logistico;
Fu accusata di aver preso parte 19 maggio 1981 ai preparativi di rapina, mai portata a termine, di un furgone blindato alla Chemical Bank di Nanuet, a New York;
Ingiuria al tribunale (nel diritto USA Contempt of Court), per aver rifiutato di fornire testimonianza sui nomi di altri militanti del movimento "19 maggio".
La condanna:Il processo si concluse nel luglio 1983 con una sentenza che può essere riassunta in questi punti:
20 anni per concorso in evasione di Assata Shakur alias Joanne Chesimard;
20 anni per associazione sovversiva, con applicazione della legge Rico, originariamente usata per casi di criminalità mafiosa e organizzata, per la quale venivano pagati dalla persona le accuse contestate al gruppo di appartenenza (cosiddetta associazione a delinquere) e per i due preparativi di rapina;
3 anni per ingiuria al tribunale (nel diritto USA Contempt of Court), per aver rifiutato di fornire testimonianza sui nomi di altri militanti del movimento "19 maggio".
Al primo arresto del 9 novembre 1982 l'FBI aveva offerto una forte somma di denaro alla Baraldini per denunciare i compagni e l'offerta le fu rinnovata in carcere con una contropartita che corrispondeva alla sua liberazione. Il rifiuto di collaborare non fece altro che inasprire la pena, qualificando la Baraldini come detenuta pericolosa. Venne quindi trasferita nel durissimo carcere di Lexington e le condizioni detentive divennero più aspre.
La Baraldini venne prima rinchiusa nel carcere di New York, poi in quello di Pleasanton in California e, poi, a Lexington, dove fu sottoposta al carcere duro con isolamento, censure nella posta e limitazioni nelle visite, sorveglianza continua anche nei momenti più intimi.

Il regime carcerario venne ridotto e l'unità di sicurezza di Lexington chiusa dopo la lotta della Baraldini e di altre carcerate, sostenuta anche da Amnesty International.
La Baraldini ha visto peggiorare in carcere il suo stato di salute. Nel 1988, dopo aver avvertito forti dolori addominali, le era stato diagnosticato un tumore maligno alla mammella. Dopo alcuni interventi chirurgici nel 1990, la Baraldini venne trasferita nel carcere di massima sicurezza di Marianna, in Florida, situato in una località isolata. L'ultimo trasferimento fu a Danbury, nel Connecticut.

" Assata Shakur "

Il 2 maggio 2005 il suo nome è stato aggiunto alla lista dei terroristi interni tenuta dall'FBI; la ricompensa prevista per l'aiuto al suo arresto è di un milione di dollari. Alcuni attivisti asseriscono che questa è un'applicazione delle leggi recentemente modificate da "un terrorista" (cioè George W. Bush) contro un "non-terrorista". La Comunità per l'applicazione di legge, particolarmente quella in New Jersey, ha sostenuto questa misura.[2] La Shakur fu madrina del rapper Tupac Shakur, figlio di un'altra attivista delle Pantere Nere, Afeni ShakurAssata Shakur, al secolo Joanne Chesimard, (conosciuta anche come madrina del rapper Tupac) è la prima donna a entrare nella lista dei 25 “terroristi” “most wanted” d’America. Rivoluzionaria afroamericana legò la sua sorte alla militanza politica negli anni ’70 col Black Panther Party.
Non si arrese allo sterminio e alla decapitazione politica dell Pantere ad opera della stessa Fbi. Animò poi una delle sue filiazioni armate, la Black Liberation Army.
Oggi Assata si chiama Joanne Chesimard, ha 72 anni, ed è stata la prima donna a entrare nella black list. È accusata dell’omicidio a sangue freddo di un agente di polizia avvenuto il 2 maggio 1973. All’epoca Assata si batteva con le armi per i diritti degli afroamericani.
Nel 1977 arrivò la condanna all’ergastolo, nel 1979 l’evasione di prigione con l’aiuto del fratello Mutulu Shakur (padre adottivo di Tupac) e dell’attivista italiana Silvia Baraldini (estradata e tornata in Italia solo nel 1999), finiti in carcere proprio per quell’azione armata. Poi trovò asilo politico a Cuba, dove tuttora vive.
Si dichiara innocente, ma mai si arrende
Riguardo alle accuse di omicidio di un agente e ferimento di un altro (motivo dell’inserimento nella lista nera) si è sempre professata innocente: ferita nella prima fase del conflitto a fuoco, ha riportato una lesione del tendine che le avrebbe reso impossibile impugnare un’arma e fare fuoco. Sostiene di non aver mai sparato i quattro colpi, due dei quali da dietro, che hanno ucciso Werner Foerster dopo essere partiti dalla pistola del collega. I federali non vogliono sentire scuse. Al perseguimento delle responsabilità effettive preferiscono il messaggio politico. Punire chiunque osi ribellarsi al dominio imperiale statunitense.
Quello che dà più fastidio agli zelanti yankees è l’impegno che Assata continua a proferire come militante politica e rivoluzionaria. Il Bureau ne è sicuro. A Cuba Assata continua a essere attiva a fa propaganda anti americana. Per lei ci sono due taglie da 1 milione di dollari l’una, offerte dal Fbi e dallo Stato del New Jersey.
L'ho incontrata a Cuba nel 2000. In queste foto quando non è sola è fotografata insieme ad Aleida Guevara, la figlia di Ernesto Chuevara, il CHE'.

William M.Kunstler l'avvocato che ha difeso i pacifisti più famosi del mondo, l'avvocato dei neri, di Assata shakur e della Baraldini.

E' stato un avvocato, attivista e poeta statunitense, politicamente vicino al progressismo.
Annoverato tra i più celebri avvocati della storia americana, Kunstler deve la sua fama alla difesa di clienti discussi e controversi, in processi che sono stati per anni al centro dell'attenzione dei mass media: da Martin Luther King ai membri delle Pantere Nere come Assata Shakur, dal gruppo degli attivisti Chicago Seven legato al Partito Yippie (caso che lo portò alla fama in tutto il paese) a El Sayyid Nosair, presunto responsabile materiale dell'uccisione del rabbino fondamentalista Meir Kahane nel 1990, dai nativi pellerossa dell'American Indian Movement (1973-1976) al cestista dell'NBA Marvin Barnes (1979)
E' soprannominato anche "l'avvocato più odiato d'America"[6], Kunstler è stato un membro del consiglio della American Civil Liberties Union (ACLU) e cofondatore del Centro di legge per i Diritti Costituzionali (CCR), il "principale punto d'incontro per gli avvocati radicali nel Paese", nonché un rinomato principe del foro.
A differenza di altri legali "anti-sistema" e garantisti (come il francese Jacques Vergès) e di molti rappresentanti della stessa ACLU (es. Alan Dershowitz, che lo ha criticato per essere un avvocato "politicizzato"), Kunstler si rifiutò sempre di difendere persone e gruppi di estrema destra (come i Minutemen negli anni sessanta e membri del Ku Klux Klan) dichiarando di voler rappresentare "solo gente che amo e di cui condivido mire e ideali", in particolare ha dichiarato: «Io difendo solo persone di cui condivido gli obiettivi. Non sono un avvocato che tutti possono assumere. Difendo solo coloro che amo».
Occasionalmente e per motivi di principio difese anche persone estranee alla sua area politica, ad esempio clienti particolarmente invisi all'opinione pubblica e al sistema, in nome del diritto di difesa, come lo sceicco terrorista Omar Abd al-Rahman.
Solo in alcune occasioni circostanziata, pro bono (cioè completamente gratis, non volendo il loro denaro di provenienza illegale), ha difeso assieme all'allievo Ron Kuby anche alcuni appartenenti alla mafia italoamericana (tra essi, John Gotti), ma perché li riteneva, per quanto riguardava specifiche accuse o violazioni procedurali, dei diritti umani o processuali nei loro confronti, "vittime del sistema".

Tra i suoi molti altri clienti famosi, i carcerati della rivolta di Attica e le loro famiglie, il comico Lenny Bruce, la leader comunista Angela Davis, il cantante Jim Morrison, i membri della Weather Underground, Christian Brando, Stokely Carmichael, Qubilah Shabazz, figlia di Malcolm X e numerose persone comuni spesso di fasce sociali disagiate.

She was accused of taking part in the robbery preparations, never completed, of an armored van at the Nanuet Chemical Bank in New York on May 19, 1981.

The sentence: The trial ended in July 1983 with a sentence that can be summarized in these points:

Baraldini was first locked up in New York prison, then in Pleasanton in California and then in Lexington, where she was subjected to hard prison with isolation, censorship in the mail and restrictions on visits, continuous surveillance even in the most intimate moments.

The prison regime was reduced and the Lexington security unit closed after the struggle of Baraldini and other prisoners, also supported by Amnesty International.
Baraldini has seen her health deteriorate in prison. In 1988, after experiencing severe abdominal pain, she was diagnosed with malignant breast cancer. After some surgical operations in 1990, Baraldini was transferred to the maximum security prison in Marianna, Florida, located in an isolated location. The last move was to Danbury, Connecticut.

"Assata Shakur"

On May 2, 2005, his name was added to the FBI internal terrorist list; the reward for helping her arrest is $ 1 million.
